New York Personal Injury Lawyer Reviews Laws Regarding Fireworks
New York State made buying, selling, and using fireworks illegal in an effort to prevent firework-related property damage, personal injury, and death.

NEW YORK, NY, July 17, 2011 /24-7PressRelease/ -- Fireworks are illegal in New York, New Jersey, Massachusetts and Delaware.

But this year, like every other, there were New Yorkers buying and using illegal fireworks.

"Unfortunately people will use illegal fireworks and some will injured, others may die," said New York personal injury lawyer David Perecman.

According to the United States Consumer Product Safety Commission (CPSC), there were reports of three fireworks-related deaths and an estimated 8,600 hospital emergency room treated firework-related injuries in 2010. More than half of the injuries were burns, and most of the injuries involved the head, hands, fingers, and legs. In another CPSC report available to New York personal injury lawyers, nearly 70 percent of all firework-related injuries occur around the Independence Day holiday.

New York Newsday reported on Eric Smith, a Long Island resident Smith who lost his arm trying to set off a mortar last year.

According to the article, Smith was hosting his yearly party, when the 3-foot-long steel pipe he was using to shoot the mortar shells became too hot, causing one to explode before he could get away. The explosion severed his arm at the shoulder in front of his guests.

This year, the New York Police Department cracked down harder on illegal fireworks in an effort to prevent fires, injuries and even deaths. Possible penalties for those convicted of fireworks use and possession include jail time and vehicle confiscation.

The police department also tried to get neighbors to turn in neighbors by offering a reward of $1000 to anyone who provides information leading to the arrest and conviction of individuals possessing or distributing fireworks in New York City.

Fireworks are dangerous. New York personal injury lawyers at The Perecman Firm understand there can be unplanned explosions even when a person is being careful. If fireworks have gotten old or damp they may react differently than intended and can cause severe burn injuries, disfigurement, blindness or even death.

Fireworks are also known to cause fires. In Bay Ridge, Brooklyn, long-time residents still talk about the 1991 house fire in which three people died, after a smoldering firecracker landed under the home's porch and set the structure ablaze.

Firework injuries can lead to lawsuits as New York personal injury lawyer Perecman knows. A person suffering personal injury caused by fireworks due to another person's negligence may be eligible to bring a lawsuit against the person responsible. Negligence means someone fails to exercise the level of care that a reasonable person should have exercised in the same circumstances.

If a person has suffered a fireworks injury in New York due to another's negligence, contact an experienced New York personal injury lawyer at the Perecman Firm.
